Terms of Service (Custom Site)

Sitebyunbased — Service Terms & Agreement

By purchasing a website build, theme, or related service from Sitebyunbased, you ("the Client") agree to the following terms. Payment constitutes acceptance of this agreement.


1. What You Are Purchasing

1.1 Your purchase includes a complete custom Shopify store setup: your choice of theme (Reign, Showcase, Skeleton, or another theme of your choice) installed on your store and fully set up and optimized for conversions — including products, online store pages, password page, and full storefront configuration.

1.2 Your purchase does not include:

  • Custom-coded features or functionality (available as a paid Addition — see 5.4)
  • SMS or email marketing setup/optimization (available as a paid Addition — see 5.5)
  • Ongoing maintenance, content updates, or support beyond the revision window
  • Shopify subscription, apps, domains, or any third-party costs (see Section 9)

2. Scope of Work

2.1 The scope of your project is defined exclusively by your completed intake form. Anything not submitted in the form is outside of scope.

2.2 Requests made through DMs, comments, or any channel other than the official form are not tracked and will not be completed. Any such request is treated as an Addition (see Section 5).

2.3 We reserve the right to decline any project or request; if a project is declined before work begins, a full refund is issued.

3. Delivery Timeline

3.1 Sites are completed within 3–7 days of receiving (a) full payment and (b) all required assets and access (collaborator code / store access, product info, images, and any other materials requested in the form). The timeline does not begin until both are received.

3.2 Progress updates are provided as milestones are reached. We ask that you allow us to work without repeated update requests — updates are sent when there is progress to report.

3.3 If your site is not delivered within 7 days of the timeline starting, contact us and we will work out next steps (completion date, partial refund, or refund per Section 7).

4. Client Responsibilities & Project Holds

4.1 The Client is responsible for providing all assets and access promptly.

4.2 If required assets or access are not provided within 7 days of purchase, the project will be marked as completed and closed out, and no refund will be issued. Work completed up to that point will be delivered as-is.

4.3 The Client warrants that all provided content (images, logos, product photos, text) is owned by or licensed to the Client. Sitebyunbased is not responsible for copyright claims arising from Client-provided content.

5. Delivery, Approval, Revisions & Additions

5.1 A project is delivered once the completed store is handed off or published and written confirmation is sent. Client approval of the delivered site (e.g., confirming the site looks good or is complete) closes the project. Any requests after approval are billed as Additions or paid revisions — no exceptions.

5.2 Each build includes one (1) round of revisions, free of charge. A revision round is a single consolidated list of edits to work already delivered within the original scope — submitted at one time, through the official form, within 7 days of delivery. Requests submitted separately or after the window count as additional paid rounds.

5.3 A revision is an edit to existing work. A revision is not new features, new pages, new products, or new services — those are Additions.

5.4 Extra revision rounds and Additions are $10 each, payable before the work is performed. Custom-coded features are $50 each, payable before the work is performed.

5.5 SMS and email marketing setup/optimization is not included in any build and is never provided free of charge. It is performed only when specifically requested by the Client and paid for as a separate service.

6. Theme License

6.1 All themes and custom sites are licensed for use on one (1) Shopify store only.

6.2 The license is non-transferable. Sharing, reselling, copying, or installing the theme on any other store is prohibited and will result in license deactivation without refund.

7. Refund Policy

7.1 Refunds are issued only under the following conditions:

  • Full refund — work on your store has not started.
  • Partial refund — your site was delivered partially complete, proportional to the incomplete portion.
  • Refund or partial refund — delivery exceeded the 7-day mark (per Section 3.3), at our discretion based on project status.

7.2 No refunds are issued for completed and delivered work, for approved work (5.1), for projects closed due to Client-caused holds (4.2), for change of mind, or for Additions already performed.

7.3 Chargebacks: You agree to contact us to resolve any issue before initiating a payment dispute. Initiating a chargeback on delivered work immediately terminates your theme license and any remaining support, and we will contest the dispute with our project records (intake form, delivery confirmations, approval messages, and admin activity logs).

8. Results Disclaimer

8.1 Our sites are built with proven, conversion-focused structure. However, we do not guarantee sales, traffic, conversion rates, or any specific business results. Site performance also depends on your product, pricing, content, and marketing.

9. Third-Party Costs

9.1 Shopify subscription fees, app fees, domain costs, and any other third-party charges are the Client's responsibility and are not included in any package.

10. Communication

10.1 The official channels for project requests are the intake form and the change-order form. These are the only channels through which work requests are accepted.

11. Portfolio Rights

11.1 Sitebyunbased may display completed work in its portfolio and marketing unless the Client requests otherwise in writing before delivery.

12. Agreement

12.1 These terms take effect upon payment. If any part of this agreement is found unenforceable, the remaining sections still apply.

12.2 Sitebyunbased may update these terms for future projects; the version in effect at the time of your payment applies to your project.
